Abstract
Background. The beginning of the 20th century witnessed the dramatic changes in the Russian political and legal reality, triggered by the state vector towards the constitutional reorganization. With the advent of political parties and the defined direction of reforms, this period seems to be one of the most relevant within the framework of historical research from the perspective of emerging concepts for building a constitutional state. The aim is to study the model of a constitutional state in the views of F.F. Kokoshkin, the most prominent representative of Russian legal studies at the beginning of the 20th century. Materials and methods. A review of historical sources, including the works of F.F. Kokoshkin, as well as the legal positions of the legal scholar contemporaries and researchers who considered his views, enable fulfilling the pursued aim. The study employs the following research methods: historical, formal legal, analysis, synthesis and comparative legal method of scientific knowledge. Results. The model of a constitutional state by F.F. Kokoshkin is considered. The main and additional features of a constitutional state are examined. The forms of the constitutional state identified by the legal scholar are studied. The historical aspect of the emergence of a constitutional state, including the prototypes of such a state, and the development of constitutionalism in various states are analyzed. Conclusions. F.F. Kokoshkin created a unique model of a constitutional state that has no analogues. The legal scholar equated the concepts of a constitutional state and a legal state, analyzing the constitutional state in the historical refraction of the constitutional institutions of foreign countries. The study of the works by the legal scholar enables revealing the guarantees to implement the fundamental features of a constitutional state. According to F.F. Kokoshkin, the most important aspects of the existence of a constitutional state are the practical exercise of the right of people to participate in lawmaking and the consolidation of the system of separation of powers.
